TERMS AND CONDITIONS
These Terms and Conditions (“Terms”) apply to your use of dollyanddotty.com.au (the “Site”) and to all orders you place with us for delivery within Australia.
Please read them carefully. By placing an order, you agree to these Terms.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (“ACL”), being Schedule 2 to the Competition and Consumer Act 2010 (Cth). Where any part of these Terms would do so, that part does not apply to you.
1. Who we are

In these Terms, “we”, “us” and “our” mean the entity above. “You” means the person placing the order.
Every order is picked, packed and dispatched from our fulfilment centre in Melbourne, Victoria, and all returns are received there (see clause 9).
2. Eligibility
To place an order you must be at least 18 years of age and legally capable of entering into a binding contract. If you are under 18, you may only use the Site with the involvement of a parent or guardian.
We supply goods for personal, domestic or household use. If you would like to buy for resale or other commercial purposes, please visit our wholesale site at dollyanddotty.com — different terms apply, and some ACL consumer guarantees may not be available on wholesale orders.
3. Products, sizing and descriptions
We sell vintage-inspired clothing and accessories. We take care to describe and photograph our products accurately.
• Colour and finish. Screen calibration varies between devices, so colours on your screen may differ slightly from the actual garment.
• Sizing. Our range is cut to our own size chart, which does not always match standard Australian sizing. Please refer to the size guide on each product page before ordering.
• Natural variation. Prints, patterns and trims may sit slightly differently between individual garments. This is normal and is not a fault.
• Care labelling. All garments are supplied with care instructions in accordance with the Consumer Goods (Care Labelling) Information Standard 2010. Damage caused by incorrect washing or care is not a manufacturing fault.
We may change our product range, specifications or packaging at any time. Changes will not affect orders we have already accepted.

4. Placing an order
Your order is an offer to buy from us. It is accepted only when we send you a dispatch confirmation email. Until then, no contract exists between us, even if you have received an order acknowledgement or your payment has been authorised.
We may decline or cancel an order (in whole or part) before dispatch if the item is unavailable, there has been an obvious pricing or description error (see clause 6), we cannot verify your payment or delivery details, we reasonably suspect fraudulent or unauthorised use of a payment method, or we reasonably suspect the order is for resale in breach of clause 2.
If we cancel before dispatch, we will notify you and refund any amount already charged in full, to your original payment method.
If you spot a mistake in your order, please contact us immediately at sales@dollyanddotty.com.au. We will do our best to amend it, but once an order has entered the picking process at our Melbourne warehouse we may be unable to change it.
5. Prices, GST and currency
• All prices on the Australian Site are shown in Australian dollars (AUD) and are inclusive of 10% GST. We are registered for GST in Australia.
• The total price payable — including delivery and any other charges — is displayed at checkout before you confirm your order. That total is the amount you will be charged.
• A tax invoice showing our ABN and the GST included in your order will be issued with your order or by email.
• We may change prices at any time, but changes will not affect orders we have already accepted.

6. Pricing and description errors
Despite our best efforts, an item may occasionally be listed at an incorrect price or with an incorrect description.
If we discover an error before dispatch, we will contact you to confirm whether you wish to proceed at the correct price or cancel. If we cannot reach you within a reasonable time, we will treat the order as cancelled and refund you in full.
7. Payment
We accept credit and debit cards through Shopify Payments. All available payment methods are shown at checkout.
• Payment is processed at the time you place your order.
• Card payments are handled by Shopify Payments under its own terms. We do not receive or store your full card number or security code.
• Ownership of the goods passes to you on full payment. Risk passes to you on delivery (see clause 8).
8. Delivery
Where we deliver. We currently ship within Australia only. If you are shopping from outside Australia, please visit our UK site at dollyanddotty.co.uk.

Estimates are the total time from when you place your order to when it arrives. Standard delivery times vary depending on where in Australia your order is going. All timeframes are estimates and are not guaranteed.
Carriers. Your order is delivered by one of our Australian courier partners. The carrier is assigned automatically based on your delivery address and the best available service at the time, so we cannot accept requests for a specific carrier. Every order is fully tracked.
Risk and title. Risk in the goods passes to you when the goods are delivered to the address you provided, or to any person at that address, or when left in a safe place in accordance with your delivery instructions.
Authority to leave. If you give an authority to leave (or the carrier’s own ATL default applies), the goods are deemed delivered when left at the address. We are not responsible for loss or theft after that point, though we will always try to help you pursue a carrier claim.
Incorrect addresses. If a parcel is returned to us or lost because the address you gave was incorrect or incomplete, we may charge you the cost of redelivery.
Undelivered parcels. If a parcel is returned to us as unclaimed, we will contact you to arrange redelivery at your cost, or refund the goods less our original outbound delivery cost.
Lost parcels. If your order has not arrived within 10 business days of the estimated delivery date, please contact us and we will investigate with the carrier. If the parcel is confirmed lost, we will replace or refund it — this is your right under the ACL and is not affected by anything in this clause.

9. Change of mind returns and exchanges
We are happy to accept returns if you simply change your mind, on the following conditions.
• Please return the item within 30 days of delivery, unworn, unwashed, undamaged and in its original condition, with all tags and labels still attached.
• Include your order number inside the parcel. You do not need to contact us first for a change of mind return.
• Return postage for a change of mind is at your cost, and we recommend a tracked service. Until we receive the item, it remains your responsibility.
• Every return is inspected on arrival at our fulfilment centre. Items showing signs of wear do not qualify as a change of mind return.
• Once received and inspected, we will refund the purchase price of the goods to your original payment method within 5 business days. Original delivery charges are not refunded on change of mind returns.
Exchanges: You may exchange an item for a different size or colour within the same 30 days and on the same conditions, subject to stock at the time your return reaches us. Return postage to us is at your cost, and your replacement is sent out with a second delivery fee.
Exclusions: We cannot accept change of mind returns on gift cards, or on items marked as made to order.

Our fulfilment centre is not a retail location: walk-in returns, in-person exchanges and over-the-counter transactions cannot be accepted. Returns sent to any other address may be delayed or refused.
This change of mind policy is offered voluntarily and in addition to your rights under the Australian Consumer Law. It does not limit those rights in any way. Sale, discounted and clearance items carry exactly the same ACL rights as full-price items.

10. Your rights under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Among other things, this means the goods we supply must be of acceptable quality, match their description and any sample or demonstration model, be fit for any purpose you told us about before purchase, and be supplied with clear title and undisturbed possession. If an item does not meet one of these guarantees, we will replace it or refund you.
Timeframes: These guarantees apply for a period that is reasonable having regard to the nature of the goods, the price paid and any statements made about them. A garment is expected to withstand normal wear and correct laundering for a reasonable time.
What is not covered: Consumer guarantees do not apply to normal wear and tear, damage caused by misuse or accident, failure to follow the care instructions, alterations made to the garment, or damage arising after you were told about a defect.

11. Faulty or incorrect items
If something arrives faulty, damaged, incorrect or not as described, please contact us at sales@dollyanddotty.com.au with your order number and photographs of the issue before sending anything back.
• We will respond within 2 business days and arrange the remedy you are entitled to under clause 10.
• We pay the return postage for faulty, damaged or incorrect items, you will not be out of pocket for returning a product that does not meet a consumer guarantee.
• Proof of purchase (your order confirmation or tax invoice) is required, though you do not need the original packaging.
• If a refund is due, we will refund the purchase price and the original delivery charge.

12. Gift cards, vouchers and promotions
• Gift cards and vouchers are valid for 3 years from the date of supply, the minimum period required by Australian law, and are not redeemable for cash.
• Promotional and discount codes are subject to their own stated terms, cannot be used in conjunction with other offers unless we say so, and may be withdrawn at any time before you place your order. Gift cards may be used alongside a discount code.
• We may cancel orders where a code has been obtained or used improperly, or in breach of its stated terms.
13. Intellectual property
All content on the Site - including text, product photography, graphics, logos, print and pattern designs, and the “Dolly and Dotty” name and branding - is owned by us or our licensors and protected by copyright and trade mark law.
You may view, download and print Site content for your own personal, non-commercial use. You must not otherwise copy, reproduce, adapt, distribute or commercially exploit it without our prior written permission.
14. Reviews, photos and user content
If you submit a review, comment, photograph or other content to us or tag us on social media, you grant us a non-exclusive, royalty-free licence to use, reproduce and display that content for marketing and promotional purposes, with attribution to your username or handle where reasonably practicable. You may withdraw that permission for future use at any time by contacting us.
You confirm that any content you submit is your own, is accurate, and does not infringe anyone else’s rights. We may remove content that is unlawful, misleading, offensive or off-topic.
15. Acceptable use
You must not use the Site to do anything unlawful, to interfere with its operation or security, to scrape or harvest data, to place fraudulent or speculative orders, or to gain unauthorised access to any part of our systems.
16. Privacy and cookies
We handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Some of the systems and service providers we use are located outside Australia.
If we send you marketing communications, we will do so in accordance with the Spam Act 2003 (Cth). Every marketing message includes a functional unsubscribe facility, and we will action unsubscribe requests within 5 business days.
What we collect, why, how we handle it and which countries are involved is set out in our Privacy Policy. The cookies we use and the choices available to you are set out in our Cookie Policy. Both form part of these Terms.
17. Our liability
Nothing in this clause limits your rights under the ACL, and nothing in it excludes or restricts our liability where the ACL does not permit that. Subject to that:
• To the maximum extent permitted by law, and where the ACL allows us to do so, our liability to you for a failure to comply with a consumer guarantee is limited to (at our election) replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of any of those things.
• We are not liable for loss or damage that was not reasonably foreseeable, or that was not caused by any breach or fault on our part.
• We are not liable for business losses, including loss of profit, revenue, business opportunity or goodwill, as our goods are supplied for personal, domestic and household use.
• We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, extreme weather, fire, flood, industrial action, carrier failure, epidemic, civil emergency, or the failure of public infrastructure or telecommunications networks. Where such an event occurs, we will notify you and, if the delay is substantial, you may cancel the affected order for a full refund.
We provide the Site on an “as available” basis and do not guarantee uninterrupted access.
18. Third-party links and services
The Site may link to third-party websites or integrate third-party services (payment providers, carriers, review platforms). We do not control those services and are not responsible for their content or their handling of your information. Their own terms and privacy policies will apply.
19. Complaints and dispute resolution
If something has gone wrong, please contact us first at sales@dollyanddotty.com.au - most issues are resolved quickly and directly. We aim to acknowledge complaints within 2 business days and resolve them within 10 business days.
If we cannot resolve it between us, you may seek assistance from the Australian Competition and Consumer Commission (accc.gov.au) or your state or territory consumer protection agency. Nothing in these Terms prevents you from taking a matter to a court or tribunal, including your state or territory civil and administrative tribunal.
20. Changes to these Terms
We may update these Terms from time to time - for example, to reflect changes to our practices, our product range or the law. The version published on the Site at the time you place an order is the version that applies to that order. Changes are not retrospective and will not affect orders we have already accepted.
21. General
• Governing law: These Terms are governed by the laws of Australia. You and we submit to the non-exclusive jurisdiction of the courts of the Commonwealth of Australia. This does not deprive you of the benefit of any consumer protection law in your own state or territory, or of your right to bring proceedings where you live.
• Severability: If any provision of these Terms is found to be unenforceable, it will be severed and the remaining provisions will continue in force.
• No waiver: If we do not enforce a right under these Terms, that is not a waiver of that right.
• Entire agreement: These Terms, together with our Shipping Info, Returns & Refunds, Privacy Policy and Cookie Policy pages, form the entire agreement between us in relation to your order. Where one of those pages sets out detail referred to in these Terms, that detail forms part of these Terms.
• Assignment: We may assign or novate our rights and obligations under these Terms to another entity, provided this does not adversely affect your rights. You may not assign yours without our consent.
